I know this is a shit system in NYC, but you have to know how it works. This building has a CO for a store and “Light Manufacturing” from 1928. That means, without submitting and getting a zoning change, or a Letter of No Objection from the Housing Preservation Committee, the DOB will do just what it did here. As you can see, the CO for this property has no mention of AIR (artists in residence) or any change to a residential building:

which have AIR tenants. Basically, in the Byzantine situation which is NYC, our DOB will allow the manufacture of Agent Orange, but doesn’t know how to treat a use like “coffee roasting”….

So when you move into a building, go online and take a look at the situation. It’s all-access information available to you. This Landlord clearly fuuuuuuuuuuucked up.

Of course this happens in Bushwick… because buildings illegally converted to residences, where illegal construction has gone on and on and on despite a stop work order, and complaints about the illegal tenancy gets a “cannot enter building” comment on DOB BIS – well if that happens to white people in Greenpoint of course they won’t do anything about it. But Bushwick? Let’s go get ‘em.

This whole thing is crazy. The Buildings Dept. (DOB) almost never evicts personss from a building constructed as a residence and situated in a district that permits residential uses unless it is close to collapse, which is obviously not the case here. (This is why this is clearly different from the Troutman St. controversy, where the building in question was both built for industry and situated in a manufacturing zone.)

I hope that the affected residents will strongly protest this stupid action, take DOB to court and win a resounding decision that will affirm their right to remain in their own apartments as the building violations are being corrected. (As a current resident of Queens, where DOB is notorious for allowing all kinds of flagrant violations to go unaddressed, I hope that actions like this will take the City’s Building Code more seriously.)

I’m one of the residents that was evicted yesterday. There is much more going on here than what that NY1 bit reveals (for example, the building may not have actually been “illegally” converted). Apparently we’ll be able to return to our homes, it’s just (as Armstrong said) it’s gonna be a matter of time.

If there’s anything that tops getting burglarized repeatedly on the residential awfulness scale, I suppose this is it! Best of luck to these unfortunate residents. These things are often cleared up, though who knows how long that will take.

The residents can hire a lawyer and stay three months longer. The city should not throw people out on the street homeless with no place to go and no notice.

This is the fourth such eviction in Bushwick. Mostly the city turns a blind eye to the illegal residences. Which I hope they keep doing because it would be terrible for Bushwick if the loft area were rezoned for residential.
